California Supreme Court Rules in Favor of Marriage Equality Upholds State Constitution’s Guarantees of Privacy, Intimate Association & Due Process
Albuquerque, NM (May 15, 2008) – In a historic decision, the California Supreme Court has ruled that existing state statute barring same-sex couples from marriage is a violation of the California Constitution because it discriminates based on sexual orientation and sex and violates the fundamental right to marry, which are protected by the California Constitution’s guarantees of privacy, intimate association, and due process.

"Today’s historic decision in California is a victory for all Americans who cherish fairness and opportunity.While New Mexicans are unaffected legally by this ruling, we are hopeful that we will someday have the same opportunity to solidify our families. This victory energizes our own efforts to continue working toward passage of the Domestic Partner Rights and Responsibilities Act in the New Mexico State Legislature, which will provide basic fairness and emergency protections for all New Mexican families. Today, the California Supreme Court ensured that all Californians are treated fairly and equally under the law according to their state constitution. Equality New Mexico will continue to work for a day when all New Mexicans are treated with respect, as well."
