In the 2019 legislative session our organizations worked to successfully pass the Vital Records Modernization Act. The bill modernized New Mexico’s process for correction of sex designation on birth certificates – a big victory for transgender, non-conforming, intersex people born in the state.

Now, we’ve got to take this fight across the finish line and ensure that the agency-level rules that implement the bill are successfully passed. We need your help!

Please use the form and suggested comment language below to write a quick comment:

THE DEADLINE TO SUBMIT COMMENT IS SUNDAY, SEPTEMBER 29TH at 11:59pm MST

SAMPLE STATEMENTS TO ADD INTO YOUR COMMENT:

Start with a statement expressing your support for the proposed rule:

  • My name is ________ and I fully support the proposed rule change to NMAC 7.2.2 implementing the Vital Records Modernization Act

Then add in some commentary about why this matters to you:

  • Transgender people may need to correct the sex designation on their birth certificates for practical, personal, and safety reasons.

  • Requiring proof of surgery or any other specific medical treatment is outdated and discriminatory.

  • Self-attestation reflects the most accurate information about a person’s gender identity.

  • A gender neutral sex designation is important to ensure accuracy and privacy on vital records.

Finally, add a conclusion:

  • Thank you for your consideration, I encourage you to accept these changes.
